Briefing a Case | Instant Homework Help
To answer some of your burning questions about how in the world you will brief a court case…I have attached a document titled How to brief a case. As you read this document you will discover that there are two types of court briefs, Appellate brief and Student brief. You will follow the student brief outline to complete your assignment. I have provided a sample brief from a previous semester as an example of how to complete this assignment. In addition, I have provided a document that provides some examples of where to find court cases. While you may use Wikipedia as a place to locate much information, I would not use it as a reference source for your research on the court cases. One other note, from my understanding, is that the first name/entity that is listed in a court case is the last one that has filed with the court. There are some cases as you research a case the order in which the names are listed are changed. One example of this is Bell v. Lone Oak Independent School District and other times you will find it listed as Lone Oak Independent School District v. Bell. One of our adjunct professors had personal dealings with this case. If you have time, look up the outcome of this case; the results changed extracurricular district rules across the State of Texas that are still present today. For this assignment, everyone will brief Brown vs Board of Education (US Supreme Court, 1954)

****MY ROLE IS THE PLANTIFFS ATTORNEY**** For this discussion, every student will be emailed a role to play on the board of directors. Read the attached case, “The Panalba Decision.” As a member of the board, you must help to reach a decision at today’s meeting (in this discussion). The Chairperson of the Board, Dr. UpJohn, has provided the case background information to each board member. Your task is to select one of the five alternatives from the “Panalba Decision” for: (1) The U.S. market; and (2) assuming the FDA does ultimately ban Panalba in the U.S., the foreign market (which will not be affected by the ban). You will be assigned a role on John’s Board. Read your role and act as if you were actually in that role. The roles all differ, so do not directly discuss your role with other board members until you post your discussion when you can then identify who you are. Based on your role, write a 400-500 word argument for the alternative you will choose for (1) the U.S. market, and (2) the foreign market (you can choose the same or different alternatives for (1) and (2)). ****MY ROLE IS THE PLANTIFFS ATTORNEY**** CASE FOR MOCK TRIAL: Wacky Motors Inc., a new and used car dealership, hired Steve Simpson to perform various duties, such as cleaning and gassing vehicles, moving vehicles from one lot to another and maintaining the showroom and vehicle lots. In this position, Steve had access to keys to the vehicle through an “ignition kiosk access process.” Under this process, a designated attendant, Cat Talley, keeps the keys in a restricted kiosk. When any employee wants to move a company vehicle, s/he must fill out a key “tag” or request form, which contains spaces for the date, time, stock number of vehicle, name of employee checking out the vehicle, and the destination of the vehicle. For example, the vehicle might be taken to a body shop for repairs or to a gas station, or to a company lot at a different location. Every time an employee checks out a vehicle, the reason must be for company business use. It was not necessary to put the expected return time on the tag, but if a vehicle was expected to be gone for a long time, this information was supposed to be put on the tag. Sometimes Cat fills the tag out for the employee. When the tag is completed, Cat adds the information from the tag to key control log, gives the keys to the employee who has requested them, and hangs the tag on the board in the control shack. When the vehicle is returned Cat crosses out the entry for the vehicle in the control log, replaces the keys, and removes the tag from the board. Sometimes vehicles are gone for more than one day, but a new page of the control entry is started each day. Some vehicles may be removed permanently if they are sold from another lot. In these cases, the managers of the other lots call to let Cat know that the vehicle will not be coming back. Sometimes employees would drive cars back and leave the keys with other employees. This practice was acceptable to the dealership. One day Steve asked Cat if he could use a car for 30 minutes on his lunch break to go to his mother’s house. Cat told him it was okay as long as he brought it back because, otherwise, she could get in trouble. Steve took the car and left. On his way back to the dealership, Steve rear-ended a car stopped at a stop light, causing injuries to the driver and a passenger. Steve told a police officer at the scene of the accident that he was on a lunch break from his job and that he had permission to drive the car, but his boss was not aware he had the car. The plaintiffs, driver and passenger, sued the car dealership on the grounds that it was responsible for the injuries caused by Steve. If you are the Plaintiffs’ attorney or Defendants attorney, please post a well-reasoned argumentative analysis to support your clients position, taking into account tort, agency, employment, and any other law that may be applicable. Use the law as set forth in your textbook to analyze these issues. Please clearly identify which party you are representing in your post.

Students will be assigned cases (court opinions) which they are to brief (summarize) in writing using their own words. Each brief should be 1 to 2 double-spaced pages in length and no more than that, otherwise it would not be brief. 😉 Your work will be graded primarily on the basis of its accuracy, thoughtfulness, conciseness, and clarity of expression. Briefs should be prepared using the following sections: Heading: The name of the case, the year it was decided, and the court that decided it. Also put your name in the header on both pages of the brief. Facts: A brief recounting of the essential facts of the case. To a certain extent, the court already has done this in any opinion, but students should use their own words as they further distill the court’s narration. Issue: A statement, in the form of a question, of the question(s) the court must answer in order to be able to decide the case. If the issue is not explicitly stated in the court opinion, its identification can be tricky. Outcome: Give the answer to the issue. What is the decision of this court? How does the court dispose of the case (e.g., reversed and remanded to lower court)? Reasoning: Explain how the court arrived at its decision. What are the logical steps in the court’s reasoning (whether they in fact are logical or not)? What rule(s) does this court apply? Dissent: If there was any dissenting opinion in the case, summarize it here. A dissenting opinion is a written explanation of why one or more appellate judges who heard the case disagreed with the majority of judges whose opinion decides the case. Most cases will not have a dissenting opinion. You will recognize the dissenting opinion, if there is one, because it will appear at the end and be clearly labeled as such. Comments: Your chance to go beyond telling the story of the case, here you can add your analysis of any weaknesses you detect in the court’s opinion. Examples of questions to consider include the following: What public policies are evident in the opinion? What are the practical implications of the case for people other than the parties to the case? What could the losing party have done differently to avoid the loss? What could the winning party have done differently to avoid this costly litigation? These are not specific questions you are required to answer, but only examples of the way you might think about the case. So that the briefs are brief, stay within these limits: o 2 pages o Double-spaced, except the heading o Minimum 12-point font o Normal margins –
