Deadly Physical Force
Kurt Kerfuffel had been drinking at the Dew Drop Inn for three hours and was noticeably intoxicated when Ronnie Reconnoiter entered the bar and sat next to him. Reconnoiter turned to Kerfuffle and made a vulgar slur. Kerfuffle got up and started to walk away when Reconnoiter violently grabbed him and pinned him up against the wall, again insulting him using obscenities. As soon as Reconnoiter released him, Kerfuffle pulled out a knife and stabbed Reconnoiter, killing him. Does Kerfuffle have any defense of justification? Consider all of the variations of this defense. If he can prove that he suffers from bipolar disorder, can Kerfuffle be acquitted on the basis of insanity? Why or why not? Arrive at a response or statement (one to two pages in length) which answers the question of whether the prosecution can prove that Kerfuffle is guilty of this homicide. Explain your answer fully with reference to the facts and the relevant law as contained in your course readings. Cite: Scheb, J. M., & Scheb, J. M., II. (2014). Criminal law and procedure (8th ed.).
