Part 1 Assume for a moment that individual hospitalized in a mental facility escapes due to a lapse in security. This individual is being housed permanently at the mental facility due to a severe impairment and the danger they pose to the general public. The individual murders someone while out in the general public. In your opinion, can this individual be charged with a crime since they were supposed to be separated from the public, but a lapse in security allowed them to go free?
